Defining consent in Maryland

The state of Maryland does not have a specific definition of consent for purposes of determining if a sex act is lawful. However, there are many factors that can be looked at when determining if a sex crime was committed. For instance, consent cannot be given if a person is under age 14 and his or her partner is four or more years older. Consent also cannot be given if a person is mentally incapacitated.

On Dec. 21, it was reported that a Maryland doctor was facing second-degree rape and multiple other sex offense charges after two of his patients accused him of assault at his clinic. The 54-year-old doctor was reportedly being held at a detention center without bond.

Web restrictions on criminal defendants


Courts have prohibited criminal defendants from using the internet as a condition of their probation or supervised release in sexual assault or other sexual offense cases. However, the U.S. Supreme Court recently recognized evolving technology and free speech protections while overturning a North Carolina law prohibiting registered sex offenders from accessing internet websites that could enable direct communications with minors.
