Are DUI and DWI the same in the eyes of the law?

Many people use DUI and DWI interchangeably. However, these two terms have distinct meanings in Maryland law – the fundamental difference between the two lies in the level of impairment necessary and their resulting penalties.

What is a DUI?

DUI stands for “driving under the influence” and is the more serious of the two charges. In Maryland, you can face DUI charges if your blood alcohol concentration (BAC) is at least .08%. What is a DWI?

On the other hand, DWI stands for “driving while impaired” and is the less serious charge. While still a serious offense, DWI indicates a lower level of impairment compared to DUI. You can get a DWI charge despite having a BAC higher than .07% but below the legal limit of .08%.

If it is your first time getting a DWI conviction, the consequences are less severe than a DUI charge. The penalties include a lower fine, a shorter prison sentence and a license suspension rather than revocation.

Additionally, there is a chance you may face a DWI charge even if your blood alcohol level is below .07%. Police officers may charge you if they believe you show sufficient signs of erratic driving or impaired behavior, such as slurred speech or poor coordination.
