Cannabis, commonly known as marijuana, is a plant known for its psychoactive properties. In Maryland, cannabis has been legal for medicinal use since 2014. Since July 1, 2023, recreational use has been legal as well. Adults aged 21 and above can possess, use and even grow cannabis.
But as with any drug use, there are certain limits. For people who like to use cannabis recreationally, it’s important to have a clear understanding of the fine line between what is legal and illegal.
What is legal?
An adult can only have up to 1.5 ounces of cannabis. State law also allows you to possess up to 12 grams of concentrated cannabis or cannabis products containing up to 750 mg of THC (tetrahydrocannabinol).
Only licensed dispensaries can legally sell and distribute cannabis. However, a buyer must present a valid government-issued ID at the point of sale. They can also only buy amounts within the legal possession limits.
Maryland also allows adults to grow up to two cannabis plants per household. If they are medical patient registered with the Maryland Cannabis Administration, they can cultivate up to four plants per household. However, anyone growing these plants must keep it out of public view and secured from unauthorized access.
What is illegal?
Underage possession and use of cannabis is illegal in Maryland. Any person under the age of 21 caught having or using cannabis may need to pay civil fines and go through mandatory education programs. The state also prohibits:
- Smoking or consuming cannabis in public places
- Driving while impaired by cannabis
- Possessing more than the legal amount of cannabis
Penalties depend on the amount and severity of use. Smoking in public may result in a $50 fine. Possessing more than 2.5 ounces but less than 50 pounds can result in misdemeanor charges. Having more than 50 pounds can lead to felony charges.
Take note that cannabis also remains illegal under federal law. This means that while its legal in Maryland, you cannot possess or use it on federal property. It is also illegal to transport it across state lines.
