For those facing criminal charges, one potential defense is to present an alibi. This is simply a claim that you were somewhere else when the crime occurred. You couldn’t have been the one responsible because you were in a completely different location at the time and you had nothing to do with the illegal activity.
For example, perhaps the police have arrested you because you match the description of a murder suspect. But you claim that you were at home watching a movie on television. You live 10 miles away from the location where the murder took place. It must have been someone else, and you don’t believe you should be convicted.
Supporting evidence
The main problem with an alibi defense is if there’s nothing to back it up. You often need to present other types of evidence, such as clear documentation that places you elsewhere or trustworthy witness statements.
For example, perhaps you share an apartment with three other roommates. If they all testify that you were in fact with them, watching a movie together in the apartment, that supports your alibi and shows that you’re telling the truth.
Or, say that you ran to the gas station to buy snacks and drinks before the movie. You have receipts from the gas station, and you were captured on CCTV footage while you were there. You also have a digital receipt from renting the movie through a streaming service. By presenting all this documentation, you support your own defense.
An alibi defense can be effective when it’s strong, but it’s important to know how to present it to the court. Be sure you understand all of the legal options you have at your disposal.
