Open container laws create specific restrictions about possessing or consuming alcoholic beverages in vehicles, and many drivers remain unaware of these regulations until they face citations during traffic stops. These laws exist separately from DUI statutes, meaning you can be charged with open container violations even if you are not impaired or over the legal blood alcohol limit for driving.

Understanding open container regulations becomes particularly important because violations can complicate DUI cases and create additional legal consequences during routine traffic stops, DUI investigations or sobriety checkpoint encounters.

Open container laws typically prohibit any vehicle occupant from possessing an open alcoholic beverage container in the passenger area while the vehicle is on a public highway. The passenger area includes all seating areas normally occupied by passengers and the driver, but generally excludes the trunk or cargo areas behind the last row of seats. An open container means any bottle, can or receptacle containing alcohol that has been opened, has a broken seal or has had contents partially removed.

Exceptions to open container laws

Despite the general prohibition against open containers in vehicles, several important exceptions exist that allow possession or consumption in specific circumstances:

  • Commercial transportation vehicles such as buses, taxicabs, limousines and other vehicles designed primarily for transporting passengers for compensation are typically exempt from open container restrictions for passengers
  • Living quarters of recreational vehicles including motor homes, motor coaches and RVs allow occupants to possess and consume alcohol in designated living areas separate from the driving compartment
  • Secured storage areas such as trunks, cargo areas behind the last row of seats or locked glove compartments may be acceptable locations for storing open containers away from the passenger area
  • Special event vehicles like party buses or chartered transportation services may have specific permits allowing alcohol consumption during designated events or routes
