Penalties increase for a DUI with a minor in the car

If you get charged with a DUI in Maryland, it can come with significant ramifications. Even a first offense could lead to up to a year behind bars and a fine of up to $1,200. For a subsequent offense, the maximum jail term is extended to two years, and the fine is doubled to $2,400. You could also face issues such as the loss of your driver’s license and the need to pay other fees or expenses. Many people see their car insurance rates increase or miss time at work, which are related consequences.

But all of that applies to a standard DUI charge, where the driver may have been the only one in the vehicle. If the person has a passenger, that can change things—especially if the passenger is under 18 years old. When the person who is convicted was transporting a minor, they could face up to two years in jail and a $2,000 fine just for a first offense. If it is a second offense, then they could face up to three years behind bars and as much as $3,000 in fines.
