You have the right to fight to avoid a drug conviction

Facing a charge of illegally possessing a controlled substance can understandably take a mental and emotional toll on you. A number of thoughts may be swirling through your head, such as whether such a charge will ultimately destroy your reputation and your future.

Federal, local and state law enforcement may fine you and hold you in prison if you are caught illicitly possessing a controlled substance. In addition, a drug conviction in Maryland can make it impossible to land certain jobs in the years ahead. Fortunately, you have the right to fight for your freedom in a court of law.

Controlled substances

Not every controlled substance is illegal in every circumstance. In fact, doctors prescribe many of these drugs to members of the general public, and dispensaries and pharmacies fill them to treat medical conditions. The federal government has created various schedules for controlled substances, such as the following:

  • Schedule I: These are substances that do not have any medical usage. Examples are heroin and marijuana.
  • Schedule II: These are stimulants and narcotics that can easily be abused and cause physical or psychological dependence. Examples are OxyContin and Percocet.
  • Schedule III: These are substances that are less likely to be abused but may still result in dependence. Examples are Vicodin and Tylenol/Codeine.
  • Schedule IV: These are substances with lower abuse potential as compared with Schedule III drugs. Examples are Xanax and Valium.
  • Schedule V: These are mostly substances that feature small narcotic amounts. An example is a cough syrup that features codeine.

Your rights

Perhaps authorities have accused you of possessing a prescription drug for personal use or even intending to distribute it. Or maybe they have claimed that you engaged in prescription fraud or doctor shopping. No matter the controlled substance-related charges you face, an attorney can quickly examine all of the evidence that prosecutors intend to furnish to support their allegations, with the goal of getting anything that is questionable thrown out.

In your drug case, your attorney might end up uncovering errors in law enforcement procedure or even violations related to search and seizure. As a result, you may end up getting your charges fully dismissed and avoid a drug conviction, or you may at least receive downgraded charges that are less serious. Your attorney's goal is to help you achieve the most personally favorable outcome in light of your drug charges, while also ensuring that your rights are protected at every stage of the criminal proceedings.
