What happens if you don’t show up for a court date?

Facing a criminal charge is stressful, and part of the process includes appearing in court when ordered. Missing a scheduled court date is a serious matter in Maryland and can carry lasting consequences. 

Understanding what can happen if you do not appear can help you avoid additional problems.

The penalties for missing court

If you fail to appear for a criminal case in Maryland, the judge may issue a bench warrant for your arrest. This means law enforcement can take you into custody at any time. In addition, failing to appear is itself a separate offense. Depending on the original charge, the court can impose fines or even jail time for missing your date.

For example, if the underlying charge is a misdemeanor, failing to appear may result in a penalty of up to 90 days in jail and a fine of up to $500. If the original charge is a felony, the penalty can be much more severe, with up to 5 years in prison and a fine of up to $5,000.

What if you had a legitimate reason?

There are times when emergencies prevent someone from attending court. Illness, accidents or other unavoidable circumstances may be considered legitimate reasons. However, the court expects proof. Medical records, accident reports or other documentation can help show that the absence was not intentional. Ultimately, it is up to the judge to decide whether the reason is acceptable.

Court dates are mandatory because they keep the criminal process moving. Missing one does not make the case go away. Instead, it usually makes the situation worse. Even if you believe the charge is minor, the state treats failure to appear as a serious matter. Attending every scheduled hearing is the best way to avoid additional legal problems.
