Traumatic brain injuries: A checklist for survivors

A traumatic brain injury (TBI) can change your life in a second. Unlike a broken bone, a brain injury is often “invisible” and does not always show up clearly on an X-ray. For many families in Maryland, this is a scary time. You may feel like your life has been turned upside down. While you focus on getting better, you also need to think about your legal rights. Maryland has strict laws, so it is important to have a clear plan.

Three parts of a brain injury case

A legal claim helps you get the money you need to pay for medical care. In Maryland, your case depends on one main rule: you must prove the other person was 100% at fault. If a court finds that you were even 1% responsible for the accident, you could lose your right to any money at all.

When we build your case, we focus on these three things:

  • Expert witnesses: Since brain injuries are hard to see, we use medical experts to explain your symptoms. Doctors like neurologists can prove how the injury affects your memory or mood. This helps stop insurance companies from saying your injury isn’t serious.
  • The marriage claim: Maryland allows a husband and wife to file a joint claim called “loss of consortium.” This pays for the damage the injury does to a marriage, such as the loss of companionship. It is important to know that this claim is only for spouses. In Maryland, children cannot currently file a claim for the loss of a parent’s guidance in these cases.
  • Planning for the future: A brain injury can require care for the rest of your life. While Maryland limits money for “pain and suffering” (the cap is $965,000 for injuries starting Oct. 1, 2025), there is no limit on money for medical bills or lost pay.
